Ironworkers Local 720 Successful on Drug & Alcohol Case
In probably one of the most important drug and alcohol cases in Alberta's history, Ironworkers Local 720 wins at the Appeals Court.
Background to This Case
Several years ago Petro-Canada decided to implement a Drug & Alcohol Policy for their site. Unlike Syncrude and Suncor who implemented their policies to start from that day forward, Petro-Canada believed they had a right to test all employees who were already working on their site.
The Ironworkers, along with Plumbers, Pipefitters and Labourers decided to challenge that decision in the courts. The challenge was a lengthy process and was unsuccessful at first; but it was taken to Alberta's highest court and the earlier decisions were all overturned (with costs) in favour of the unions.
What this means is that if any other owner chooses to implement a Drug & Alcohol policy on their site it can only be from that date forward and no individual who is already employed on site will have to be tested.
